Montgomery Township Man Admits to Public Masturbation

Alvin B. Rosenberger III, 44, pleaded guilty to three counts of indecent exposure for masturbating along his neighbor's tree line in plain view of her home

The female neighbor, who was the visual victim of Alvin B. Rosenberger III as he masturbated along her tree line in a one-hour period on May 3, 2012, would be pleased to know Rosenberger admitted to his indecent exposure incident in Montgomery County Court of Common Pleas on Thursday.

According to Peg Gibbons from PhillyBurbs.com, Rosenberger III, 44, of the 1600 block of North Line Street, Montgomery Township, pleaded guilty to three counts of indecent exposure.

The plea was open, meaning there is no agreement on a sentence, according to the article.

Sentencing was postponed by Judge Joseph Smyth pending a background report on Rosenberger III, the article stated.

Rosenberger III faces three to six years in prison on the charges.

Rosenberger III was arrested May 17 and charged with five counts of indecent exposure and five counts of disorderly conduct for masturbating in plain view, while staring directly at the woman’s house in the 1600 block of North Line Street, according to The Reporter.

The article stated that the affidavit of probable cause outlines how Rosenberger stood in and exposed himself in a tree-lined area of North Line Street that separated the victim's backyard from his property.

According to the affidavit:

The actor ... would look directly at the victim’s home, making sure she was at the window when he engaged in his lewd and offensive conduct.

According to the article, Montgomery Township Police said there was one occasion where Rosenberger was seen by the victim, but he only made an obsence gesture in her direction.

The affidavit stated that the victim photographed the suspect.

Mr. Rosenberger will not do a day in prison. The author of this article knows it, EVERY reader of this article knows it. Mr. Rosenberger will undergo a psychological evaluation, be sentenced to county prison with and "immediate work release" stipulation, perform so community service; whereas he will have one of his political peers illegally comfirm he performs, and will go about his business, in his sick and demented way. Even though Mr. Rosenberger lives within 2500 feet of a school, his affluence will prevent his picture from being displayed on the Pa. State Police Megan's Law website. Come on, we all know that unless Mr. Rosenberger is selling crack-cocaine out of the Junction House, or had sex with a minor boy/girl, he is most likely not looking at anything more than a pat on the behind for this disgusting act, don't we ? Shame on Montgomery County, and the Office of the District Attorney for not sending this man where he belongs ! Ten to One, next summer or shortly thereafter, we'll be reading about Mr. Rosenberger coming back with multiple "adoptive" children from Thailand, to make "penance" for his mistakes... Stay tuned.

Frankly, if he was on his own property, I'm not sure what can be done, other than to warn him off. Weirdo yes. Criminal not so much.

Kathleen, Are you for real ? Do you really feel a person can do what this guy did and it not be against the law. This would be the same as saying you can walk around on your property naked in plain view of children, but, I am on my property, nothing you can do. Wake up
