Perkasie Cop Who Shot Marino Still on Leave

Officer Seth Mumbauer remains on leave through an internal investigation by Peraksie Borough Police

Seth Mumbauer, the Perkasie Borough Police officer who fired the fatal shot at Michael W. Marino June 9 in Sellersville, remains on administrative leave during an internal police department investigation, according to Bob Keeler of The Souderton Independent. Keeler's article states Mumbauer remains on leave, but Officer Steven Graff and Sgt. James Rothrock have retuned to duty. Perkasie Borough Police Chief Joseph Gura told Keeler that he could not comment on the findings of Bucks County District Attorney David Heckler because of pending litigation. Bucks DA: Marino Death 'Justifiable Homicide'

David Heckler found that "loss of tactical control" by police did not rise to level of criminal wrongdoing

Update, 5:38 p.m. July 30 Bucks County District Attorney David Heckler called the investigation into the death of Michael W. Marino "thorough and impartial" and defended claims that Marino was "society's victim in these events" by describing the victim as "drug-abusing, mentally ill and violent." He said to prosecute Officer Seth Mumbauer would make him "a scapegoat for those who decided Marino could be free without supervision." During a 3 p.m. press conference in his office in the Bucks County Courthouse, Heckler said Mumbauer shot Marino once in the chest. Marino's hands were cuffed behind his back, Heckler said.
