Lansdale Man Gets 30 Days to 23 Months for Serial Public Masturbation

A Lansdale father, who masturbated in plain view of women and girls under the age of 18 on five occasions in Lansdale Borough, was sentenced to 30 days to 23 months in Montgomery County prison Wednesday.

Gerald F. Boyce, 41, of the 600 block of Wissahickon Avenue, pleaded guilty to the indecent exposures charges in December for incidents that occurred between June 2011 and May 2012. Boyce heads to jail on Feb. 4, according to Peg Gibbons of The Intelligencer.

Boyce, who was charged with attempted rape in Philadelphia in 2000, committed five public masturbation incidents wherein eight of the 10 victims were underage. Boyce has a criminal history of indecent exposure and corruption of minors, according to court records.

Boyce is the father of an 8-year-old daughter, according to reports.

After he is released from prison and completes parole, Boyce will serve four years’ probation, according to the Intelligencer article.

Boyce must complete psychological therapy and then complete a 12-step program, according to Gibbons.

He also must pay $1,000 in fines and perform 100 hours of community service, according to the Intelligencer report.

Boyce was busted in the parking lot of Lansdale train station on May 14 around 4:10 p.m., while masturbating outside his black 2009 Ford F-150 extended cab pickup truck with a tan stripe. Boyce was under plainclothes surveillance by Lansdale Police Officer Patrick McKernan.

McKernan had seen a tan and black pickup truck matching the description of the suspect vehicle in prior incidents — a black pickup truck with a tan stripe.

"None of those girls were underage, were they?" Boyce asked Lansdale Detective Adrienne Duffy during his initial interrogation, according to court records.

While being interviewed by Duffy on May 14, Boyce did not deny involvement in the incidents. 

He told Duffy he could not talk to her about what he had done because he would lose custody of his daughter, according to the court affidavit.

Boyce also asked if he would be placed on the Pennsylvania Megan's Law.

According to the Intelligencer article, Boyce will not be registered as a sex offender with Megan’s Law in Pennsylvania.

Boyce was charged, but never prosecuted, for attempted rape in Philadelphia in 2000.

Furthermore, Boyce Jr. was charged in 1999 by Philadelphia Police with indecent exposure and open lewdness.

He was also found guilty in 1997 of indecent exposure, open lewdness and corruption of a minor.

A charge of indecent exposure was dropped at a January 2001 preliminary hearing in Philadelphia Municipal Court by Judge Glynnis Hill for the June 2000 case, according to court records.

Philadelphia County prosecutors eventually dropped the charges of attempted rape, sexual assault, unlawful restraint, recklessly endangering another person and harassment in July 2002 during a dispostion, according to Philadelphia Court of Common Pleas records.

Boyce did plead guilty to indecent assault, corrpution of a minor and simple assault, according to court records.
